InsiderAdvantage: State Senator Calls for Increased Sentencing for Gun Violence

State Sen. Brandon Beach, R-Alpharetta, wants to get tough on gun violence in Georgia. Monday, Beach introduced Senate Bill 7, also known as the “3G” bill or the “Gangs, Guns, Gone” bill which imposes a 10 year mandatory minimum sentence for anyone who uses a gun while committing or attempting to commit a violent felony.
The new legislation would require that this mandatory minimum sentence is given any time charges are brought against an individual who has used a gun to commit or attempt to commit a violent felony, whether or not the weapon was discharged.
The bill also states that this 10-year sentence “shall be served prior to any other sentence imposed and shall not be suspended, stayed, probated, deferred, or withheld, and any such person sentenced pursuant to this provision shall not be eligible for any form of pardon, parole, or early release administered by the State Board of Pardons and Paroles or for any earned time, early release, work release, leave, or any other sentence-reducing measures under programs administered by the Department of Corrections, the effect of which would be to reduce the sentence except as may be authorized by any existing or future provisions of the Constitution of Georgia.”
“We are not going to allow these District Attorneys to let these violent offenders back out on the street,” said Beach. “Anyone who commits any of these violent crimes at gunpoint should not be allowed to walk away.”
Under SB 7, Judges would have to impose this sentence on individuals who use even the threat of a gun to subdue another individual while committing a violent crime.
According to a spokesperson, Lt. Gov. Burt Jones is expected to address public safety later this week. Comments on SB 7 could be included in his speech.
The filing of the legislation comes on the heels of another violent weekend in Atlanta, including an anti-police protest unraveled in Atlanta where rioters set a police vehicle ablaze and smashed windows in response to the police-involved shooting of an armed activist days earlier.
